Arty is a Partner and Head of IP Disputes in the UK. She focuses primarily on litigation and has acted in several leading cases over the past 23 years – in the High Court, Court of Appeal and CJEU. Arty also advises clients on how best to protect their IP to create valuable business assets which can be readily enforced against third parties.

Arty is ranked in Chambers, Legal 500 (leading individual), IAM Patents 1000, Managing Intellectual Property IP Stars (patents and trade marks), WIPR Leaders, World Trademark Review 1000 and Who’s Who Legal (patents and trade marks). One recent quote described Arty as: “an exceptional advisor who is commercial and technically excellent. A real star of the profession.”

Arty advises on all IP rights. In relation to patents, Arty is part of the legal team acting for Unwired Planet in its landmark Standard Essential Patent and FRAND licensing dispute against Huawei ([2018] EWCA Civ 2344; UK Supreme Court, October 2019). This is the leading case worldwide on how Standard Essential Patents for 2G/3G/4G telecommunication standards should be licensed to implementers. Other patent cases have involved motion sensing, location tracking, virtual reality and high tech mechanical inventions. In relation to trade marks, Arty recently acted for the successful claimant in Frank Industries v Nike [2018] EWHC 1893 (Ch) concerning trade mark infringement, passing off and invalidity (descriptiveness). She has acted in cases involving exhaustion of rights (parallel imports), marks with a reputation, and extended form passing off. Recent copyright cases include distribution and communication right issues. In relation to designs, she has acted in cases involving spare parts and right to repair.

Arty has particular experience of urgent relief such as Interim Injunctions, Search Orders (executing and supervising), Freezing Injunctions, Norwich Pharmacal Orders and Anti-Suit Injunctions.

Arty joined Osborne Clarke in 2017, prior to which she was a partner for 13 years at international IP firm Rouse.

Arty is Secretary of the Intellectual Property Lawyers’ Association (IPLA). For IPLA, she sits on the Intellectual Property Enterprise Court (IPEC) Users’ Committee and chairs the IPLA’s Brexit working group for trade marks and designs.
